Automate Compliance TodayMinnesota's Department of Agriculture takes the position that cannabis seed (from plants over 0.3% THC) may be sold by any seller — not only OCM-licensed businesses — provided the sale complies with the Minnesota Seed Law (Minn. Stat. 21.80–21.92, labeler permit and labeling requirements) and applicable Chapter 342 rules. Under Minn. Stat. 342.09, adults 21+ may cultivate up to 8 plants (4 mature) at home and gift limited amounts of cannabis to other adults without remuneration. Since Dec. 1, 2025, OCM Guidance Memo GM-2025-05 requires licensed cultivators to source propagative material from OCM-authorized sources in Metrc. Hemp cultivation requires an MDA license under Minn. Stat. ch. 18K, with hemp propagule sales subject to Minn. R. 1565.1000 COA requirements.
