Under Proposition 207 (Smart and Safe Arizona Act), A.R.S. § 36-2852 permits adults 21+ to possess and cultivate up to six marijuana plants per adult (twelve per household) and to transfer up to one ounce or six plants to another adult 'without remuneration' — seeds are marijuana under A.R.S. § 36-2850. Licensed marijuana establishments may sell seeds, though in practice most Arizona consumers buy from seed banks, which is lawful for personal cultivation. Hemp cultivation and hemp nursery/propagation activity require licensing from the Arizona Department of Agriculture under A.R.S. § 3-311 et seq., but consumer possession of viable seed is not restricted.
