CBD is illegal in Madagascar. Law No. 97-039 does not distinguish CBD from other cannabis-derived substances, and the Agence du Médicament de Madagascar (AMM) has not registered any cannabidiol product, including pharmaceutical Epidyolex.

Imports of CBD oils, tinctures, gummies, and cosmetics are routinely held by the Douanes at Ivato and require a special import authorization (autorisation d'importation) from the Ministry of Public Health, which has not been granted for CBD. Travelers carrying CBD risk seizure and prosecution under the narcotics law. The Code de la Santé Publique (Law No. 2011-002) gives the Ministère de la Santé Publique authority to schedule novel substances, but no rule has been issued to carve CBD out of the cannabis prohibition.
