CBD is legal in Colombia across three distinct regulatory channels: pharmaceutical preparations, cosmetics, and food. All routes flow through INVIMA, the national health surveillance authority. CBD derived from cannabis plants with more than 1% THC by dry weight falls under the medical cannabis framework set by Law 1787 of 2016 and Decree 613 of 2017, requiring a manufacturing license from the Ministerio de Salud and finished-product registration with INVIMA.
Cosmetic CBD products are governed by Decision 833 of 2018 of the Andean Community and INVIMA Circular 100-00208-21, which require a mandatory cosmetic notification (NSOC) before sale. Food and dietary supplement use opened in November 2021 when Resolution 2118 of 2021 authorized hemp seed, hemp seed oil, and hemp flour as foods, and Decree 811 of 2021 cleared the path for CBD-containing food products subject to INVIMA sanitary registration. Imported finished CBD products must clear INVIMA registration; products marketed without it are subject to seizure under Decree 677 of 1995. Pharmacy dispensing of magistral CBD formulations is permitted with a medical prescription under Resolution 315 of 2020.

CBD finished products may be imported and exported subject to INVIMA sanitary registration and, where the source plant exceeds 1% THC, a quota authorization from the Fondo Nacional de Estupefacientes. Decree 811 of 2021 expressly permits export of CBD isolates, extracts, and finished consumer goods, and Colombia has emerged as a significant CBD supplier to the EU, Brazil, and Australia. Hemp-derived CBD from plants under 1% THC follows a lighter import regime but still requires INVIMA notification or registration.
