Industrial hemp is legal in Colombia and treated as cannabis no psicoactivo when the plant contains 1% or less THC by dry weight. The classification comes from Article 2 of Decree 613 of 2017, and licensing sits with the Ministerio de Justicia y del Derecho for seed and cultivation, and the Ministerio de Salud for processing into derivatives.

Decree 811 of 2021 widened the field considerably, allowing seed use, cultivation, and manufacture of finished products from non-psychoactive cannabis to feed into food, beverages, cosmetics, textiles, construction materials, and animal feed. Resolution 2118 of 2021 cleared hemp seed, hemp seed oil, and hemp flour for human consumption, and Resolution 227 of 2022 set the technical requirements for hemp food ingredients. ICA registers approved hemp cultivars and seed banks. Operators need four core authorizations: a non-psychoactive cultivation license from the Ministerio de Justicia, a seed use license, ICA seed registration, and INVIMA notification for the finished product.

Import Export Rules for the Country

Hemp seed, fiber, hurd, and finished products under 1% THC may be imported and exported. Seed imports require an ICA phytosanitary import permit and registration of the cultivar; commercial seed cannot be sold without ICA registration under Resolution 3168 of 2015. Decree 811 of 2021 explicitly authorizes export of non-psychoactive cannabis derivatives and finished products. Quota approval from the Fondo Nacional de Estupefacientes is not required for plants verified at or below the 1% THC threshold.
