CBD products with no more than 0.3% THC are tolerated in French Guiana under the French regulatory framework following the European Court of Justice ruling in Kanavape (C-663/18) and the Conseil d'Etat decision of 29 December 2022. The arrete of 30 December 2021 permits commercialisation of cannabis sativa varieties listed in the EU Common Catalogue, with finished products required to stay at or below 0.3% delta-9-THC.
CBD flower and leaf sales remain disputed following Conseil d'Etat litigation, but extracts, oils, cosmetics, and e-liquids meeting the 0.3% threshold can be marketed. Agence nationale de securite du medicament (ANSM) classifies high-CBD pharmaceutical products separately, and Epidyolex (cannabidiol) is authorised for specific paediatric epilepsy indications under the French medicines code. Cayenne pharmacies follow the same Agence regionale de sante (ARS) Guyane oversight as mainland France.
