Recreational marijuana is decriminalized in Saint Kitts and Nevis. The Cannabis Act 2020, together with 2020 amendments to the drugs legislation, removed criminal penalties for adult possession of up to 56 grams (about 2 ounces) of cannabis and household cultivation of up to five plants for personal use.
The Medicinal Cannabis Authority, established under the Act, regulates licensed cultivation, processing, research, and supply for medicinal use; the Act's licensing parts (Parts III–VII) were brought into operation on 20 April 2024. Quantities above 56 grams remain criminal under the Drugs (Prevention and Abatement of the Misuse and Abuse of Drugs) Act, Cap. 9.08. Public smoking within 10 meters of a school or place of worship attracts a fixed penalty. Religious use by registered Rastafari has limited carve-outs under Section 30 of the Cannabis Act. There is no adult-use commercial retail market; licensing under the Act is limited to the medicinal cannabis industry.

Recreational cannabis import and export are prohibited except by Medicinal Cannabis Authority licensees with Import/Export Permits. Customs at Robert L. Bradshaw International Airport and Vance W. Amory International Airport screens all parcels. Personal importation by visitors, even from decriminalized jurisdictions, triggers prosecution under Cap. 9.08.
