Industrial hemp is effectively illegal in San Marino. Law No. 78/1994 controls Cannabis sativa L. without a domestic low-THC carve-out comparable to Italian Law 242/2016, and no Sammarinese industrial hemp licensing scheme has been established.
The Republic's small territory and agricultural ministry have not opened a pathway for low-THC cannabis cultivation. Hemp foods and products imported through Italian retail channels may circulate informally, but commercial Sammarinese hemp cultivation or processing is not authorized. The ISS and the Segreteria di Stato per il Territorio l'Ambiente e l'Agricoltura have no licensing framework for industrial hemp. Imported hemp materials are subject to Sammarinese narcotics law and Italian customs.
