Is Weed Legal in San Marino?

Recreational marijuana is illegal in the Republic of San Marino. The Sammarinese Criminal Code and Law No. 78 of 2 June 1994 (Disciplina degli stupefacenti) regulate narcotics and prohibit possession, cultivation, sale, and supply of cannabis. San Marino operates an independent legal system but maintains close cooperation with Italy under bilateral conventions, and Italian DPR 309/1990 informs many of the operational definitions and scheduling practices.

The Gendarmeria of San Marino and the Polizia Civile enforce narcotics offenses across the 61-square-kilometer territory. Possession penalties include fines and administrative sanctions; cultivation and trafficking attract imprisonment under the 1994 Act and the Criminal Code. San Marino does not operate an airport; access is by road from Italian territory, and customs cooperation with the Italian Guardia di Finanza covers narcotics interdiction. No recreational cannabis legalization has been enacted, and a 2020 referendum-era discussion about therapeutic cannabis advanced only a limited medical framework.
