Recreational marijuana is decriminalized for private adult use in South Africa, and medical marijuana is legal under a tightly controlled pharmaceutical regime. The Constitutional Court's 18 September 2018 ruling in Minister of Justice v Prince held that criminalizing private cultivation, possession, and use of cannabis by adults in private was inconsistent with the right to privacy under Section 14 of the Constitution.

Parliament codified the ruling through the Cannabis for Private Purposes Act 7 of 2024, signed by President Cyril Ramaphosa on 28 May 2024. The Act removes cannabis and THC from the schedules of the Drugs and Drug Trafficking Act 1992 for private adult use, sets prescribed limits expected by regulation in 2025-2026, and creates a graduated offense structure that distinguishes private use from commercial dealing. Adults 18 and over may cultivate, possess, and consume cannabis in private. Public consumption, sale to consumers, and supply to minors remain criminal. The South African Police Service (SAPS) continues to enforce against unlicensed commercial trade, and Western Cape and Gauteng have run high-profile shutdowns of so-called cannabis clubs operating outside the private-use exemption.

The Department of Trade, Industry and Competition's Cannabis Master Plan envisions a fuller legal commercial framework but enabling legislation for adult-use retail has not yet passed.
