Is Weed Legal in Ukraine?

Recreational marijuana is illegal in Ukraine, but medical cannabis became legal in 2024 under a wartime reform package aimed primarily at military veterans with PTSD. The Criminal Code (Article 309) and the Code on Administrative Offenses (Article 44) govern personal possession, while Article 305 covers trafficking.

Possession of small quantities, defined as less than 5 grams of cannabis or less than 0.5 grams of hashish, is an administrative offense punishable by a fine of 17 to 51 non-taxable minimum incomes (currently UAH 289 to UAH 867) under Article 44. Possession of larger quantities is criminal under Article 309 and attracts up to three years for personal-use volumes, escalating to five years for repeat offenses. Trafficking, manufacturing, and sale under Article 305 carry three to eight years, with aggravating factors lifting the maximum to fifteen years. The National Police and the Bureau of Economic Security lead enforcement, and wartime conditions have shifted operational priorities but not the statute.
