Cannabis seeds are not separately scheduled under Belgium's Drug Law of 24 February 1921 and the Royal Decree of 6 September 2017, and buying them rarely triggers prosecution on its own. Germination constitutes cultivation, which is a criminal offence, although prosecution guidelines give lowest priority to one plant per adult for personal use. Supplying seeds knowingly for illicit cultivation can be prosecuted as participation in a drug offence, and hemp farmers must declare crops and sow EU-catalogue varieties.
