CBD is heavily restricted in Denmark and treated as either a medicinal product or an unauthorised novel food, depending on form and claims. Lægemiddelstyrelsen (the Danish Medicines Agency) classifies CBD products with a physiological effect as medicines under the Medicines Act, meaning they require a marketing authorisation and a prescription; no such authorisation has been granted for over-the-counter CBD oil. Ingestible CBD falls under Regulation (EU) 2015/2283 on novel foods, and Fødevarestyrelsen enforces the EU Novel Food Catalogue position that CBD extracts are unauthorised for food use without pre-market approval.
Finished CBD products sold in Denmark must contain no detectable THC; any THC presence triggers the Act on Euphoriant Substances and is prosecuted as cannabis. Cosmetic CBD products are permitted if compliant with Regulation (EC) 1223/2009 and notified through the EU CPNP portal. Enforcement actions by Fødevarestyrelsen have removed CBD foods and supplements from shelves; importing CBD oil for personal use without a prescription is also unlawful.

Commercial import of CBD as a food or supplement requires novel food authorisation under Regulation (EU) 2015/2283, which has not been granted. Import as a medicine requires a Lægemiddelstyrelsen company authorisation and a marketing authorisation for the specific product. Personal-import of CBD oil from abroad is treated as importing an unlicensed medicine and is intercepted by Toldstyrelsen. Intra-EU shipments are not exempt: Danish authorities apply national medicines rules irrespective of legality in the country of origin.
