Recreational cannabis is illegal in Denmark under the Act on Euphoriant Substances (Lov om euforiserende stoffer, LBK nr 1334 af 09/12/2019), which places cannabis on List A and forbids import, export, sale, purchase, delivery, receipt, manufacture, processing, and possession. Personal-use possession is prosecuted: a first offence for under 10 grams of hashish or roughly 50 grams of herbal cannabis typically draws a fixed fine of around 2,000 DKK, with second and third offences escalating by 50% and 100%.
The long-tolerated open market on Pusher Street in Freetown Christiania was physically dismantled in April 2024 after residents voted in August 2023 to close it; Copenhagen Police maintain a sustained presence there to prevent sales resuming. Denmark has no recreational legalisation bill before Folketinget. Enforcement is handled by the Rigspolitiet under the Ministry of Justice, with the Director of Public Prosecutions setting fine guidelines. Quantities above 100 grams move into custodial sentences, and possession of 10 kilograms or more carries 10 to 16 years under the Penal Code.

Import and export of recreational cannabis are flatly prohibited under §1 of the Act on Euphoriant Substances. Only Lægemiddelstyrelsen can authorise cross-border movement of cannabis, and only for medicinal, scientific, or veterinary purposes under a company licence (virksomhedstilladelse). Customs enforcement is handled by Toldstyrelsen; trafficking is prosecuted under §191 of the Danish Penal Code (Straffeloven), with sentences up to 16 years.
