Recreational marijuana is illegal in Equatorial Guinea. Law No. 4/1980 on the trafficking of narcotic and psychotropic substances, supplemented by Law No. 3/1991 on dangerous drugs, classifies cannabis as a prohibited narcotic. Cultivation, possession, transport, and sale are criminal offences carrying imprisonment of one to twenty years depending on quantity and the role of the accused, with the highest penalties for trafficking.
The Policia Nacional and the Ministerio de Seguridad Nacional enforce drug law. Penalties are routinely applied against foreign nationals; consular protection does not waive prosecution. Searches are common at Malabo International Airport (SSG) and at Bata Airport (BSG), and travellers carrying cannabis face arrest, fines, and deportation following sentence.
