Is Weed Legal in Palestine?

Recreational marijuana is illegal across the Palestinian territories, but enforcement is jurisdictionally complex. In the West Bank, the Palestinian Authority applies the Anti-Narcotic Drugs and Psychotropic Substances Law No. 7 of 2013, which lists cannabis (hashish) and its resin as controlled substances. Sections 26 and 27 punish possession with imprisonment of 1 to 3 years and fines of 1,000 to 5,000 Jordanian dinars; cultivation, manufacture, and trafficking under Sections 28 to 32 carry 5 to 15 years and fines up to 50,000 dinars. In Gaza, Hamas authorities apply a separate decree-law mirroring the 2013 statute with similar penalties.

Israeli law applies in Area C and East Jerusalem under the Israeli Dangerous Drugs Ordinance (1973), enforced by the Israel Police; Palestinians arrested there are typically prosecuted in Israeli military courts under Military Order 1651. The Palestinian Anti-Narcotics General Administration in Ramallah coordinates West Bank enforcement; the Public Prosecution at the Palestinian High Judicial Council prosecutes cases. No medical or commercial framework has been opened by the PA or the de facto Gaza authorities.
