Recreational cannabis is illegal in Poland. The Drug Prevention Act of 29 July 2005 (Ustawa o przeciwdziałaniu narkomanii) classifies cannabis and THC as controlled substances in Annex I-N and II-P, and possession of any amount can trigger criminal liability under Article 62, with penalties up to three years' imprisonment. Prosecutors may discontinue proceedings for small quantities intended for personal use under Article 62a, but enforcement varies by region and the law itself remains prohibitionist.
Medical cannabis became legal on 1 November 2017 when an amendment to the Drug Prevention Act allowed pharmacies to compound cannabis-based prescription products. Patients need a prescription from any licensed physician, and the prescription is dispensed at pharmacies as a magistral preparation. The Główny Inspektorat Farmaceutyczny (GIF) supervises pharmaceutical distribution, while the Office for Registration of Medicinal Products (URPL) authorises each batch of raw cannabis flower. Supply ran short through 2023 and 2024, pushing pharmacies to import flower from Czech and German producers under GIF-issued permits. Home cultivation remains a criminal offence regardless of purpose.

Import of medical cannabis raw material requires a GIF permit issued under the Pharmaceutical Law, and each batch must be authorised by URPL before pharmacies can dispense it. Supply gaps in 2024 led to a sharp increase in flower imported from licensed Czech and German producers. Export of cannabis from Poland is restricted to licensed pharmaceutical operators and tracked through the EU's controlled-substances reporting system. Recreational import or cross-border transport remains a criminal offence under Article 55 of the Drug Prevention Act.
