Is Hemp Legal in Romania?

Industrial hemp is legal in Romania for licensed farmers. Law No. 339/2005 on the legal regime of plants, substances and narcotic and psychotropic preparations, together with EU agricultural rules, allows cultivation of Cannabis sativa varieties listed in the EU Common Catalogue with THC at or below 0.3 percent.

The Ministry of Agriculture and Rural Development licenses cultivation, while the National Anti-Drug Agency (ANA) monitors compliance. Romanian farmers grow hemp for seed, oil, fiber, and CBD raw material, particularly in Moldavian and Transylvanian regions with historic hemp traditions. Operators must source EU-approved seed, submit field declarations to APIA (Payment and Intervention Agency for Agriculture), and tolerate inspections that include THC testing on flowering material.

Hemp foods, textiles, and construction materials circulate freely within the EU single market. Smokable hemp flower above 0.3 percent THC is treated as cannabis under Law 143/2000 and carries criminal penalties.
