Recreational marijuana is illegal in Romania, and medical access remains extremely narrow. Law No. 143/2000 on the Combating of Drug Trafficking and Illicit Drug Use classifies cannabis as a high-risk drug under Table II, with possession, cultivation, sale, and import all criminalized.
Personal possession of a high-risk drug carries three months to two years of imprisonment or a fine under Article 4(2), while trafficking offenses range from five to twelve years under Article 2. First-time offenders may receive treatment alternatives under Law 522/2004, but criminal records still attach. The General Anti-Drug Directorate (DGA) within the Romanian Police, supported by DIICOT (Directorate for Investigating Organized Crime and Terrorism), enforces these provisions and prioritizes trafficking cases tied to Balkan supply routes.
Romania has not joined the wave of European reform. A 2019 medical cannabis bill was rejected by the Health Committee in May 2025, leaving Law 339/2005 as the limited medical framework that allows narrow imports of approved cannabinoid medicines such as Sativex without an active prescribing infrastructure.
