Recreational marijuana is illegal in the Republic of Tajikistan. Cannabis is controlled under the Criminal Code of the Republic of Tajikistan (Articles 200 to 204) and Law No. 873 of 2000 on Narcotic Drugs, Psychotropic Substances and Precursors.
Article 200 punishes illegal manufacture, acquisition, storage, transport, or transfer with up to 5 years' imprisonment for personal-use quantities. Article 200 Part 2 (intent to distribute, group, large quantities) escalates to 5 to 10 years; Part 3 (especially large quantities, organized criminal group, supply to minors) carries 10 to 15 years with property confiscation. Article 201 (illegal cultivation in large amounts) and Article 289 (smuggling of narcotics) historically carried capital punishment, with the death penalty under a moratorium since 2004 and reduced in practice to 25 years. The Drug Control Agency under the President of the Republic of Tajikistan, established in 2000, leads enforcement alongside the Ministry of Internal Affairs.
