Recreational marijuana is illegal in Vatican City State. As a sovereign micro-state surrounded by Rome, the Vatican applies its own legal system under the Fundamental Law of Vatican City State 2000 and Law No. CCCLXXXIV of 1 October 2008 on the sources of law, with Italian criminal law applied supplementally pursuant to the Lateran Treaty of 1929 and the related concordat framework.
Italy's Presidential Decree 309/1990 (Testo Unico Stupefacenti), as amended, governs narcotics offenses including cannabis. Recreational use, possession, sale, and cultivation of cannabis are criminal offenses, with administrative sanctions for personal-use quantities and criminal penalties for trafficking. The Gendarmerie Corps of Vatican City State enforces public order within the 44-hectare territory, and the Pontifical Swiss Guard provides ceremonial and protective duties. Saint Peter's Square access is controlled, and any contraband encountered at entry points is referred under cooperative arrangements to Italian authorities.
