Law No. 30681 (2017) and its regulations allow licensed production, import and commercialization of cannabis for medical and therapeutic use, with seeds sourced through authorized laboratories and imports overseen by SENASA; Law No. 31312 (2021) added licensed cultivation by patient associations. Law No. 32195 (December 2024) created an industrial hemp regime for varieties under 1% THC covering food, textile and CBD uses. Outside these licences, Article 296-A of the Criminal Code punishes commercializing or transferring cannabis seeds with five to ten years' imprisonment, so gifting viable seed without authorization is a crime.
