Is marijuana legal in Peru?
Peru permits medical cannabis under Law 30681, enacted in November 2017, amended by Law 31312 in 2021, and implemented through the consolidated regulation approved by Supreme Decree 004-2023-SA, which replaced the original Supreme Decree 005-2019-SA.
Is CBD legal in Peru?
CBD in Peru falls under the same Law 30681 framework as medical cannabis. There is no separate legal carve-out for low-THC or hemp-derived CBD, every cannabidiol product sold as a therapeutic preparation must hold a sanitary registration from DIGEMID, regardless of THC content.
Is hemp legal in Peru?
Peru does not yet have a fully operational industrial hemp regime distinct from its medical cannabis framework.
Can you travel to Peru with cannabis or CBD?
Import of medical cannabis products requires prior authorization from DIGEMID, including a sanitary registration for finished preparations and import permits issued per shipment. CBD imports require DIGEMID sanitary registration of the specific product plus a per-shipment import permit.

Law No. 30681 (2017) and its regulations allow licensed production, import and commercialization of cannabis for medical and therapeutic use, with seeds sourced through authorized laboratories and imports overseen by SENASA; Law No. 31312 (2021) added licensed cultivation by patient associations. Law No. 32195 (December 2024) created an industrial hemp regime for varieties under 1% THC covering food, textile and CBD uses. Outside these licences, Article 296-A of the Criminal Code punishes commercializing or transferring cannabis seeds with five to ten years' imprisonment, so gifting viable seed without authorization is a crime.
