Swedish case law treats cannabis seeds as outside the Narcotic Drugs Penal Act (1968:64) because seeds contain no THC, so possessing or receiving them is not a narcotics offence, but germinating a seed is cultivation and selling seeds to facilitate growing risks complicity liability. Industrial hemp escapes the narcotics definition only when EU-catalogue varieties are grown on registered agricultural land under CAP rules, and the Medical Products Agency proposed tightening this exemption in a 2024 report.
