The Narcotics Control Act, 2018 (Act No. 63 of 2018) prohibits the cultivation, production, possession, sale and transport of cannabis in all its forms, continuing a ban on ganja that has stood since 1989. Courts hold discretionary power to impose the death sentence for offences involving more than two kilograms of cannabis, while smaller quantities can bring up to five years' imprisonment. The Act contains no industrial hemp exemption or licensing scheme, leaving no lawful basis for acquiring or distributing viable seed. Preparations traditionally made with cannabis seed, such as bhang, fall under the same prohibition.
