Recreational and medical marijuana are legal in Malta under tightly drawn rules. Malta became the first EU member state to legalize personal adult-use cannabis when Bill 241 passed in December 2021, creating Chapter 628 of the Laws of Malta and establishing the Authority on the Responsible Use of Cannabis (ARUC).
Is CBD legal in Malta?
CBD is legal in Malta when sold as a food supplement, cosmetic, or licensed medicine, provided the product meets EU and Maltese rules.
Is hemp legal in Malta?
Industrial hemp is legal in Malta when cultivated from EU-approved seed varieties listed in the EU Common Catalogue of Agricultural Plant Species with a THC content not exceeding 0.3 percent.
Can you travel to Malta with cannabis or CBD?
Personal import and export of cannabis remains prohibited. CBD products meeting EU Novel Food rules and the 0.2 percent THC ceiling move freely within the EU single market.

The Authority on the Responsible Use of Cannabis Act (Act No. LXVI of 2021) legalized adult use and home cultivation of up to four plants, and seeds are excluded from the legal definition of cannabis, so they are not a controlled substance. Licensed Cannabis Harm Reduction Associations may sell members up to 20 cannabis seeds per month for home growing, and seeds may also be imported from other EU states. Sharing or gifting harvested cannabis remains illegal, but transferring seeds themselves is not prohibited. Hemp growing follows EU rules requiring certified catalogue varieties within the 0.3% THC limit.
