Law No. 92-52 of 1992 on narcotics ('Loi 52') criminalizes use, possession, sale and cultivation of cannabis, with sale carrying up to 10 years and production up to life; a 2017 amendment merely gave judges discretion over the one-year mandatory minimum for first-time use. Seed supply is treated as illegal under the Narcotics Act since cultivation and supply of cannabis are banned outright, and Tunisia recognizes no low-THC hemp category. Reform debate continued into late 2025 — the Justice Minister told parliament over 10,000 prisoners were held on drug offences — but no legalization or seed carve-out had passed as of mid-2026.
