Botswana historically banned all cannabis, including hemp and CBD, under the Drugs and Related Substances Act, as confirmed by a BoMRA prohibition notice. Parliament passed the Cannabis Act, 2025 in August 2025 to regulate cultivation, production, import, export and processing strictly for medicinal, scientific, research and industrial purposes, and Cannabis Regulations gazetted in January 2026 set out licence categories including cultivation, import and export. Until the Act fully commences and licences are issued, any unlicensed sale, purchase or gifting of viable seeds remains criminal, and recreational cannabis stays prohibited.
