Is marijuana legal in Ecuador?
Recreational marijuana in Ecuador is decriminalized in principle but enforcement has tightened significantly. Article 364 of the Constitution treats drug use as a public-health matter rather than a crime, and the 2014 Organic Comprehensive Criminal Code (COIP) preserves the principle that personal use should not be punished.
Is CBD legal in Ecuador?
CBD is legal in Ecuador for medical and cosmetic use under the framework that legalized non-psychoactive cannabis in 2019.
Is hemp legal in Ecuador?
Industrial hemp is legal in Ecuador for licensed operators. The September 2020 Ministerial Agreement 109 from the Ministry of Agriculture and Livestock (MAG) opened cultivation of non-psychoactive cannabis with THC below 1.0 percent, and ARCSA built complementary rules for processing and finished products.
Can you travel to Ecuador with cannabis or CBD?
Recreational cannabis import and export are prohibited. CBD imports require ARCSA registration, certificates of analysis, and customs clearance through SENAE.

The 2019 reform to the Código Orgánico Integral Penal (effective June 2020) removed hemp below 1% THC from controlled-substance schedules, and Ministerial Agreement 109-2020 created licences including one specifically for the import and production of hemp seeds and cuttings. Seeds must be certified under the Ley Orgánica de Agrobiodiversidad, Semillas y Fomento de la Agricultura Sustentable (LOASFAS) and cleared by the Ministry of Agriculture (MAG), so uncertified viable cannabis seed cannot lawfully circulate. Cultivation of psychoactive cannabis remains a criminal offence under the COIP, and a citizen-initiative cannabis bill was still in early legislative stages in 2026.
