Is marijuana legal in New Caledonia?
Recreational marijuana is illegal in New Caledonia. As a sui generis French overseas collectivity (collectivite sui generis) under Title XIII of the French Constitution and the Noumea Accord of 1998, the territory applies the French Code de la sante publique and the Code penal to drug offences.
Is CBD legal in New Caledonia?
CBD has no established retail market in New Caledonia. While metropolitan France permits the sale of CBD products derived from authorised industrial-hemp varieties with no more than 0.3 percent THC following the Conseil d'Etat's 2022 ruling and the 30 December 2021 arrete, the application of these rules in New Caledonia depends on local legislative competence under the Loi organique du 19 mars 1999.
Is hemp legal in New Caledonia?
Industrial hemp cultivation is not established in New Caledonia. The territory's agricultural competence is devolved under the Loi organique du 19 mars 1999, but the Direction du Developpement Rural (DDR-NC) and the Chambre d'Agriculture et de la Peche has not opened a hemp licensing programme equivalent to the metropolitan French registration with the Etablissement national des produits de l'agriculture et de la mer (FranceAgriMer).

New Caledonia sets its own poisonous-substances (substances vénéneuses) regulation through its government and Congress, and cannabis remains classified as a narcotic, with French criminal drug offences applying to sale, possession and transfer. By decision of 9 April 2025 the government removed only CBD from the local narcotics list, and even CBD is prescription-only. Territorial phytosanitary rules prohibit importing hemp seeds, treated as an invasive-species risk, so even low-THC seed cannot be freely brought in. A hemp sector is being built by exemption only: a small pilot plot is cultivated under government derogation, with a regulated non-narcotic hemp roadmap planned for 2026-2030.
