New Caledonia sets its own poisonous-substances (substances vénéneuses) regulation through its government and Congress, and cannabis remains classified as a narcotic, with French criminal drug offences applying to sale, possession and transfer. By decision of 9 April 2025 the government removed only CBD from the local narcotics list, and even CBD is prescription-only. Territorial phytosanitary rules prohibit importing hemp seeds, treated as an invasive-species risk, so even low-THC seed cannot be freely brought in. A hemp sector is being built by exemption only: a small pilot plot is cultivated under government derogation, with a regulated non-narcotic hemp roadmap planned for 2026-2030.
