Ley 20.000 (2005) penalizes unauthorized cultivation under Article 8 but does not punish private personal consumption, and courts have repeatedly protected genuine self-supply home grows, allowing seed banks and grow shops to trade openly in cities like Santiago and Valparaíso. Viable cannabis seeds are not listed as controlled substances, so buying, possessing or handing them over is not prosecuted in practice. Medical patients may cultivate with a physician's prescription under Supreme Decree 84 (2015) as clarified by a 2023 amendment, while industrial hemp cultivation requires authorization from the Servicio Agrícola y Ganadero (SAG).
