Recreational cannabis is decriminalised in Chile for personal, private use under Law No. 20,000 of 2005.
Is CBD legal in Chile?
CBD is legal in Chile as a pharmaceutical product under Decree No. 84 of 2015 (modifying Decree No. 405) and supplementary Ministerio de Salud resolutions. Cannabis-derived medicines, including CBD oils, may be prescribed by a registered physician and dispensed through licensed pharmacies.
Is hemp legal in Chile?
Industrial hemp cultivation is legal in Chile under the Servicio Agrícola y Ganadero (SAG) regime, which authorises licensed growers to cultivate Cannabis sativa for industrial fibre and seed production.

Ley 20.000 (2005) penalizes unauthorized cultivation under Article 8 but does not punish private personal consumption, and courts have repeatedly protected genuine self-supply home grows, allowing seed banks and grow shops to trade openly in cities like Santiago and Valparaíso. Viable cannabis seeds are not listed as controlled substances, so buying, possessing or handing them over is not prosecuted in practice. Medical patients may cultivate with a physician's prescription under Supreme Decree 84 (2015) as clarified by a 2023 amendment, while industrial hemp cultivation requires authorization from the Servicio Agrícola y Ganadero (SAG).
