Cuba's Penal Code (Law No. 151 of 2022) treats drug production, trafficking and possession as serious crimes, with cultivation of significant quantities punishable by four to twenty years and no decriminalization threshold for personal amounts. There is no medical cannabis, hemp or seed licensing framework of any kind, so viable cannabis or hemp seed cannot be lawfully sold, acquired or gifted. In June 2025 the Supreme People's Court (Dictamen 476) further hardened prosecution standards for cannabinoid-related offences.
