Kazakhstan's Criminal Code criminalises the cultivation of narcotic plants and trafficking in cannabis, so viable marijuana seeds cannot lawfully be sold, gifted or possessed by individuals despite vast wild cannabis stands in the Chu Valley. A law signed by President Tokayev in 2025 legalised industrial hemp (THC roughly 0.1–0.3%) under licences issued by the Ministry of Internal Affairs, with a pilot operating in Kostanay region and five licensed legal entities by October 2025. Certified low-THC hemp seed is therefore available only to those licensed enterprises under strict state control.
