Criminal Law 1340/88 keeps unauthorized cannabis cultivation and seed dealing illegal, but two licensed regimes coexist: Decree 2725/2019 (with SENAVE Resolution 1595/2019) regulates industrial hemp under 0.5% THC, requiring MAG authorization coordinated with SENAD/MIC and SENAVE-registered imported varieties such as Fedora 17, Felina 75, Futura 32, Yuma and Bama. Law 6007/2017 (PROINCUMEC) allows cannabis plant and seed imports for the medical program, authorized by DNVS and SENAVE under SENAD supervision, restricted to entities like the National University of Asunción, IPTA and licensed laboratories — home cultivation was not authorized. Outside these licences, an individual acquiring or gifting viable seeds has no legal cover.
