Is marijuana legal in French Guiana?
Recreational marijuana is illegal in French Guiana. As an overseas department and region of France (DROM), the territory applies the French Code de la sante publique (Articles L3421-1 et seq.) and the Code penal Article 222-37 to all cannabis offenses, with enforcement by the Gendarmerie nationale and Direction territoriale de la police nationale in Cayenne.
Is CBD legal in French Guiana?
CBD products with no more than 0.3% THC are tolerated in French Guiana under the French regulatory framework following the European Court of Justice ruling in Kanavape (C-663/18) and the Conseil d'Etat decision of 29 December 2022.
Is hemp legal in French Guiana?
Industrial hemp cultivation is authorised in French Guiana under the same framework that governs metropolitan France.

As an overseas department, French Guiana applies French law: Article R.5132-86 of the Code de la santé publique bans all cannabis operations except EU-catalogue hemp varieties with THC of 0.3% or less under the arrêté of 30 December 2021. Sale or purchase of viable marijuana seeds is therefore prohibited, and unlike some EU states France does not tolerate a collector market for germinable high-THC seed. Certified hemp seed may be sold to and sown by professional farmers only, not private individuals.
