Under Law 19.172 (2013) and its IRCCA regime, psychoactive cannabis seeds move only through state-authorised channels: IRCCA imports or authorises seeds and cuttings, and registered home cultivators (10,392 active registrations at end-2025) may acquire them from IRCCA-authorised producers for up to six plants per household. Seed producers must also register with INASE and list cultivars in the national registry, with psychoactive-use approval from IRCCA. Open commercial retail of viable seeds outside these channels is not permitted, and informal gifting sits outside the authorised framework, though sharing occurs within registered household cultivation. Industrial hemp (max 1% THC in plants) requires MGAP authorisation and INASE cultivar registration under Decree 372/014.
