The Suchtmittelgesetz (SMG, BGBl. I Nr. 112/1997) controls cannabis, resin and THC but does not treat viable seeds or non-flowering plants as narcotics. Grow shops and garden centres openly sell seeds and seedlings — roughly 300,000 seedlings a month — and an offence only arises when plants are brought to flower to harvest THC. Hemp seed of EU-catalogue certified varieties (max 0.3% THC) may be sown under CAP rules without a special narcotics licence. A proposal by the governing People's Party to ban seed and seedling sales has been discussed but not enacted as of mid-2026.
