Is marijuana legal in Austria?
Recreational marijuana is illegal in Austria, but medical cannabinoid medicines are legally available. The Suchtmittelgesetz (Narcotic Substances Act, SMG), in force since 1998, governs all cannabis offenses, and a 2016 amendment shifted small-quantity personal use toward administrative handling rather than criminal prosecution.
Is CBD legal in Austria?
CBD is legal but tightly regulated in Austria. Since the 2025 retail reforms, CBD oils, hemp flower below 0.3 percent THC, and related products may be sold only through licensed tobacconists (Trafiken) and are subject to tobacco taxation.
Is hemp legal in Austria?
Industrial hemp is legal in Austria when cultivated from EU Common Catalogue varieties containing 0.3 percent THC or less. The Federal Ministry of Agriculture, Forestry, Regions and Water Management (BML) supervises cultivation, and farmers register fields with Agrarmarkt Austria (AMA) under the Common Agricultural Policy.
Can you travel to Austria with cannabis or CBD?
Recreational cannabis import and export are prohibited. CBD products meeting the 0.3 percent THC ceiling and Austrian retail rules trade within the EU single market.

The Suchtmittelgesetz (SMG, BGBl. I Nr. 112/1997) controls cannabis, resin and THC but does not treat viable seeds or non-flowering plants as narcotics. Grow shops and garden centres openly sell seeds and seedlings — roughly 300,000 seedlings a month — and an offence only arises when plants are brought to flower to harvest THC. Hemp seed of EU-catalogue certified varieties (max 0.3% THC) may be sown under CAP rules without a special narcotics licence. A proposal by the governing People's Party to ban seed and seedling sales has been discussed but not enacted as of mid-2026.
