Is marijuana legal in the Democratic Republic of the Congo?
Recreational marijuana is illegal in the Democratic Republic of the Congo. Ordonnance-loi No. 71-079 du 26 mars 1971 sur les stupefiants et la Loi No. 73-009 portant Code penal (as amended) criminalise cultivation, possession, transport, sale, and use of cannabis (bangi or chanvre).
Is CBD legal in the Democratic Republic of the Congo?
CBD is illegal in the Democratic Republic of the Congo. The 1971 narcotics ordonnance-loi does not exempt cannabidiol, and the Direction de la Pharmacie et du Medicament (DPM) has not authorised CBD products.
Is hemp legal in the Democratic Republic of the Congo?
Industrial hemp is not authorised in the Democratic Republic of the Congo. The Ministere de l'Agriculture has no licensing framework for Cannabis sativa L., and the 1971 narcotics ordonnance-loi captures all cannabis biomass regardless of THC content.

The Democratic Republic of the Congo enforces strict prohibition of cannabis with no framework for medical use or industrial hemp, and hemp and CBD are not legally distinguished from marijuana. A reported 2021 decree on medicinal use never produced a functioning programme, so no licences for cultivation or seed importation exist in practice. Possession and supply are criminalised with imprisonment and heavy fines under long-standing narcotics provisions.
