Decreto No. 48-92, the Ley Contra la Narcoactividad, prohibits the production, possession, trafficking and commercialization of narcotic plants and treats every Cannabis sativa variety alike, with no THC threshold creating an industrial hemp exemption. There is no seed, hemp or cultivation licensing framework, and the Ministry of Agriculture (MAGA) issues no hemp permits, so viable seed of any cannabis type has no legal channel. Reform proposals such as Iniciativa 5053, which would have carved out authorized cultivation, had not been enacted as of mid-2026.
