Recreational and medical marijuana are illegal in Honduras. The Ley sobre el Uso Indebido y Trafico Ilicito de Drogas y Sustancias Psicotropicas (Decree No. 126-89 of 1989) governs all cannabis offenses and treats possession, cultivation, sale, and import as criminal acts.
Is CBD legal in Honduras?
CBD is illegal in Honduras in practical terms. Decree No. 126-89 lists cannabis and its derivatives among controlled substances without carving out hemp-derived cannabidiol, and the Agencia de Regulacion Sanitaria (ARSA) has not issued registrations or guidance authorizing CBD products.

Decreto No. 126-89, the Ley sobre el Uso Indebido y Tráfico Ilícito de Drogas y Sustancias Psicotrópicas (1989), expressly prohibits the germination of seeds, cultivation of seedlings and any cannabis derivative, with seeds themselves named among the banned materials. No industrial hemp framework or THC threshold exists, so viable low-THC hemp seed is treated identically to marijuana seed. Cultivation-related offences carry six to fifteen years' imprisonment under Articles 33–34, rising to twenty years in aggravated cases.
